Judge Lets Key Parts of Alabama’s Strict Immigration Law Stand

A federal judge refused Wednesday to block key parts of a closely watched Alabama law that is considered the strictest state effort to clamp down on illegal immigration, including a measure requiring immigration status checks of public school students.

U.S. District Judge Sharon Blackburn, appointed by Republican President George H.W. Bush, wrote in her 115-page opinion that some parts of the law are in conflict with federal statutes, but others aren’t.

She said federal law doesn’t prohibit checking students or suspects pulled over by police. She also refused to stop provisions that allow police to hold suspected illegal immigrants without bond; bar state courts from enforcing contracts involving illegal immigrants; make it a felony for an illegal immigrant to do business with the state; and make it a misdemeanor for an illegal resident not to have immigration papers.

An appeal is all but certain; the state attorney general’s office said it was reviewing the decision before commenting.

An order the judge previously issued temporarily blocking the entire law expires Thursday, but it was unclear when the state might begin enforcing the sections of the law that Blackburn allow. Neither Gov. Robert Bentley nor Alabama Attorney General Luther Strange had any immediate comment.

Blackburn’s order temporarily blocked four parts of the law until she can issue a final ruling. Those measures would:

— Make it a crime for an illegal immigrant to solicit work.

— Make it a crime to transport or harbor an illegal immigrant.

— Allow discrimination lawsuits against companies that dismiss legal workers while hiring illegal immigrants.

— Forbid businesses from taking tax deductions for wages paid to workers who are in the country illegally.

Blackburn heard arguments from opponents including the Obama administration, immigrant-support groups and civil libertarians before it was supposed to take effect Sept. 1. The Justice Department contended the state law encroaches on the federal government’s duty to enforce immigration law, and other opponents argued it violated basic rights to free speech and travel.

She put the entire law on hold last month, but didn’t rule on whether it was constitutional, saying she needed more time.

Similar, less-restrictive laws have been passed in Arizona, Utah, Indiana and Georgia, and federal judges already have blocked all or parts of those.

Immigration became a hot issue in Alabama over the last decade as the state’s Hispanic population grew by 145 percent to about 185,600. While the group still represents only about 4 percent of the population, some counties in north Alabama have large Spanish-speaking communities and schools where most of the students are Hispanic.

Alabama Republicans have long sought to clamp down on illegal immigration and passed the law earlier this year after gaining control of the Legislature for the first time since Reconstruction. GOP Gov. Robert Bentley signed it, saying it was vital to protect jobs of legal residents.

Both supporters and critics say it is the nation’s toughest partly because of a section that would require public schools to verify the citizenship status of students and report statistics to the state. Illegal immigrants wouldn’t be barred attending public schools, but opponents contend the law is designed to decrease enrollment by creating a climate of fear.

In a statement on behalf of 150 United Methodist pastors who signed a letter opposing the law, Revs. Matt Lacey and R.G. Lyons said church leaders were “pleased to see some of the harsh and far-reaching elements of the law have been struck down.”

“We feel that many of these elements, written by members of the State House and Senate who campaign on Christianity, are not representative of the message of Christ who welcomed the stranger despite country of origin or status,” they said.

North Carolina Governor Suggests Suspending Elections to Spur Economic Solutions

The solution to the nation’s jobs crisis: suspend congressional elections?

That was the proposal put forward by North Carolina’s governor, who was trying to make a point at a Rotary Club event that political considerations are hindering efforts in Washington to tackle unemployment and economic stagnation.

“I think we ought to suspend, perhaps, elections for Congress for two years and just tell them we won’t hold it against them, whatever decisions they make, to just let them help this country recover,” Gov. Bev Perdue, a Democrat, said, according to a report by the Raleigh News & Observer. “You want people who don’t worry about the next election.” 

It wasn’t clear how serious Perdue was about giving lawmakers a get-out-of-an-election-free card — especially considering that Congress’ approval rating is in the gutter — but Republicans quickly pounced on her remarks.

“Now is a time when politicians need to be held accountable more than ever,” local GOP spokesman Rob Lockwood said in a statement to the newspaper. “Does the governor not believe that people of North Carolina have the ability to think for themselves about whether or not the actions of elected officials are working?”

Paul Coble, a GOP candidate for a House seat from North Carolina, also took exception to Perdue’s comments.

“That’s a proposal that only the politicians that have worsened our economic mess could appreciate,” Coble, who is chairman of the Wake County commissioners, told the News & Observer.

Perdue’s office later released a statement suggesting she wasn’t really calling for a suspension of elections.

“Governor Perdue was obviously using hyperbole to highlight what we can all agree is a serious problem: Washington politicians who focus on their own election instead of what’s best for the people they serve,” a spokeswoman said.

A 26-year-old Massachusetts man was arrested Wednesday and accused of plotting to blow up the Pentagon and U.S. Capitol using large remote-controlled aircraft laden with explosives, as well as attempting to assist Al Qaeda in attacking U.S. troops overseas.

Rezwan Ferdaus of Ashland, Mass., was arrested Wednesday in Framingham after undercover FBI agents delivered weapons Ferdaus allegedly sought for the alleged plan. The stash included what he thought was 25 pounds of C-4 explosives, as well as three grenades and six fully-automatic AK-47 assault, a press release from the Department of Justice reads.

Ferdaus was arrested after he took the the materials and locked them in his storage unit, according to an affadavit that says the storage unit was rented under a false name in June.

The public was never in danger from the explosives, as undercover agents monitored the alleged plot and kept up frequent contact with Ferdaus, the press release read. More than 30 federal, state and local agencies in the FBI’s Joint Terrorism Task Force worked together in the operation, including police departments in Worcester, Ashland and Framingham and the ATF.

In recorded conversations, Ferdaus said he planned to attack the Pentagon and U.S. Capitol using aircraft similar to “small drone airplanes” that were guided by GPS equipment, the affidavit said. The plan called for three remote-controlled aircraft to carry out the attacks, along with six other gunmen divided into two teams, with Ferdaus coordinating the operation.

In May, Ferdaus traveled from Boston to Washington, D.C., to take photos of the Pentagon and Capitol for surveillance. He planned to launch the C4-filled aircraft from sites at the East Potomac Park, authorities allege, and an F-86 Sabre remote-controlled aircraft was delivered to Ferdaus’ storage facility in August.

Authorities say they gave Ferdaus multiple opportunities to back out of the plot, as they told him it would likely kill women and children. But Ferdaus never wavered in his plan, the affidavit said.

“I just can’t stop; there is no other choice for me,” he allegedly said.

Ferdaus, who is a Northeastern University graduate with a degree in physics, is accusing of beginning in early 2010 a plot to bring violent “jihad” against the U.S, who he described as “enemies of Allah.”

He also supplied eight mobile phones to undercover FBI agents who he thought were recruiters for Al Qaeda, authorities said. The phones were modified to be used as electrical switches for IEDs, and Ferdaus thought they could be used to kill American soldiers, the affidavit said. Ferdaus also allegedly made a training video to demonstrate how to make more the weapons.

Ferdaus said “that was exactly what I wanted,” when he was told one of the devices killed three U.S. soldiers and injured four to five others in Iraq in June, authorities said.

Ferdaus faces up to 15 years in prison if convicted of providing material support and resources to a foreign terrorist organization, up to 20 years for a charge of attempting to destroy national defense premises. He also faces a five-year minimum mandatory prison sentence and up to 20 years if convicted of attempting to damage and destroy U.S.-owned buildings with explosives.

He was expected to appear Wednesday afternoon in federal court in Worcester, Mass.

“I want the public to understand that Mr. Ferdaus’ conduct, as alleged in the complaint, is not reflective of a particular culture, community or religion,” said Carmen Ortiz, U.S. Attorney for the District of Massachusetts. “In addition to protecting our citizens from the threats and violence alleged today, we also have an obligation to protect members of every community, race and religion against violence and other unlawful conduct.”

If we don’t stand up and stop the Obama Administration’s destruction of our rights and freedoms through unconstitutional control over our laws, America as we know it  will be “Toast”.  In this bizarre alliance between the EPA and FDA. This administration has chosen to remove a tried and true epinephrine asthma  inhaler because its propellant is perceived to harm our atmosphere.

A perception that is based on Al Gore’s “Convenient Lie” that is the basis for his multi-billion dollar environmental cartel. A perception that  has resulted in the EPA determining that carbon dioxide, a gas that ALL humans exhale, is a pollutant contributing to global climate change and should be regulated under the Clean Air Act..

When you consider the harm that the EPA is imposing upon us, like their Phasing out of epinephrine inhalers, it is time to consider firing the entire agency and startingall over again.

 

“WASHINGTON (The Blaze/AP) — If you have asthma and rely on an over-the-counter inhaler, you’ll need to switch a prescription-only alternative by 2012 as part of the federal government‘s latest attempt to protect the Earth’s atmosphere. And this switch will probably cost you.

The Food and Drug Administration said Thursday patients who use the epinephrine inhalers to treat mild asthma will need to switch by Dec. 31 to other types that do not contain chlorofluorocarbons, an aerosol substance once found in a variety of spray products but has since been removed from many.”

Three sheriffs push for federal Secure Communities program

Deval Patrick and his Minions propagation of the myth that the Secure Communities program was deporting illegal aliens with noncriminal records has been clarified by ICE.

“Federal immigration officials released new statistics last week to bolster their assertion that the agency is focusing on deporting criminals and, in another priority, on flagrant violators of immigration law.

According to the figures, which cover October 2008 to July 31 of this year, 52 percent of the 369 immigrants deported from Boston were convicted criminals.

About 48 percent of the deportees had no prior criminal record. But the agency provided new details that showed for the first time that most noncriminal deportees were more serious violators of immigration law, including 68 people with outstanding deportation orders and 49 people who allegedly returned to the United States after having been deported – a felony offense, though they were not convicted of it.

The remaining 60 noncriminal deportees had allegedly crossed the border illegally or overstayed their visas. The federal agency has touted Secure Communities as an initiative that could make cities and towns safer.

Federal officials said that the program helped find Joao Brito in Boston, who was wanted in his native Netherlands on charges of human smuggling and sexual abuse of children.”

The ICE clarification confirms testimony presented by Jessica Vaughan an expert on , Director of Policy Studies at the Center for Immigration Studies, to Governor Patrick’s public safety Secretary, Mary Beth Heffernan. Testimony that was ignored when the governor caved in and blocked Secure Communities implementation in MA.

Governor Patrick  even now continues his deception with his statement that  “…he is concerned Secure Communities could lead to ethnic profiling” . This though he full well knows that the FBI policy related to him is to forward  solely  fingerprints to ICE for identification. That’s right, no photos, no physical or ethnic description for everyone arrested.

Breaking News: Herman Cain Wins Florida Presidential Straw Poll

ORLANDO, FL- In an upset victory, former Godfather’s Pizza CEO Herman Cain has won the Republican Party of Florida’s Presidential Straw Poll with 37.1% of 2,657 votes cast by Florida GOP delegates. Texas Governor Rick Perry came in second with 15.4%, and former Massachussetts governor Mitt Romney, who did not actively participate in the poll, came in third with 14%. Congresswoman Michele Bachmann, who won the Iowa Straw poll in August, came in last place with 1.5 %.

Senator Jim Demint Speaks Frankly About Republicans and their Relationship to the Tea Party

I wrote about in the book , The Great American Awakening of what the grass roots movement did to change things in 2010. And actually we saw signs of that when you [Huckabee] first ran. But 2012 may be our [The American People’s] last chance to turn things around and what I want people to know is that the power to save our country is in their hands and we need to get them back engaged with the process. I want to be part of that and I’m going to follow where the grass roots go as far as the presidential race.

Huckabee: Let’s talk about the book because in it you said that something happened in you, a personal change because of the crisis in the country. What was that moment?

Demint: Well Mike when I first came to Congress and I was elected in 1998 and I was elected to the House. We had about $5T in debt and I thought that I was joining a Republican team that was going to reform the tax code fix Social Security, help people buy their own health insurance. And I’m afraid I ran into a Republican Party that was really focused more on getting re-elected, taking home the bacon and over the years in the House, I lost the confidence in the Party. And by the time I got to the Senate, I just decided that “My Team” was outside of Washington and I got involved as much as I could with the grass roots movement [Tea Party] and trying to replace not only Democrats but some of our Republicans. My Party Leaders did not necessarily get behind the folks like Marco Rubio, and you [Huckabee] were involved there early, Rand Paul, Pat Tomey. I knew these people would move our country in the right direction. So what changed in me is the realization that I had to change my Party or at least be a part of changing it before I could give the country a choice about which party they should vote for. That meant losing some friends in Washington, taking a lot of grief inside Washington.

 

 

Report: Turkish frigates to confront Israeli ships in Mediterranean

“The Turkish Navy is planning to dispatch three frigates to the Eastern Mediterranean to ensure freedom of navigation and to confront Israeli warships if necessary, a Turkish news report said on Monday.

The Turkish frigates, to be dispatched by the Navy’s Southern Sea Area Command, will provide protection to civilian ships carrying humanitarian aid to Gaza, blockaded by Israel since 2007, the Turkish daily Sabah reported. If the Turkish warships encounter an Israeli military ship outside Israel’s 12-mile territorial waters, they will advance up to 100 meters close to the ship and disable its weapon system, in a confrontation that resembles dogfights in the Aegean Sea with Greek jet fighters, according to the report.”

Glenn Beck has been warning that the Middle East Crisis has entered a new phase. Turkey had been a staunch ally of the West since joining NATO in 1952 and  in 1996 they became the first Muslim Country  to ever sign a  Mutual Defense cooperation agreement with Israel. Relations with Israel began to fade when the Islamic Justice and Development Party came into power in 2002, headed by  Recep Tayyip Erdogan. Islamic Fundamentalists had been seeking to overthrow the Turkish Government for decades. However, the military has acted as guarantor of  Turkey’s secular republic since being entrusted with that power in 1923 by Musta Kemal Ataturk , the” Father of Modern Turkey”.

However,  in 2003 after being elected, Prime Minister,   Recep Tayyip Erdoga began moving Turkey away from a secular republic, towards a Muslim Theocracy. Fearing a military coup, he  was very careful not to move forward to quickly or to recklessly . Then on April 8th of this year, Recep Tayyip Erdog was able to appoint new senior generals, friendly  to his cause,  in a move seen as consolidating his control over the military.

This is the backdrop and the reason why placing 3 frigates outside of  Israeli waters  is fraught with danger  and could lead to military  confrontation at any moment.  Read more here:

What was a significant moment for our nation has sadly become an afterthought for many in our culture today. It seems Americans have forgotten the significance and meaning of the Constitution, which grants us freedom and liberty, and our elected officials have forsaken the very document our founders masterfully created.
