Families of Navy SEALs killed in 2011 attack say government is to blame

WASHINGTON – The families of Navy SEAL Team 6 members killed in a disastrous August 2011 helicopter crash in Afghanistan blamed the government for the tragedy, during an emotional press conference in Washington Thursday.

The family members, speaking at the National Press Club, tried to reopen the book on the crash, in which 30 Americans were killed, most of them belonging to the same unit as those who carried out the raid on Usama bin Laden earlier that year. The helicopter was shot down by insurgents.

During the event organized by a group called Freedom Watch, family members and former military personnel claimed President Obama turned the SEALs group into a Taliban target after the administration revealed they had conducted the bin Laden raid.

Doug Hamburger, whose son Patrick was killed, called the incident an “ambush” that could have been prevented.

“We’re very concerned that the administration had disclosed that the Navy SEALs had carried out a successful attack on bin Laden’s compound resulting in his death. And you know, never before in the history of our county (had) a sitting president released that type of information to the public, especially when he was talking about special forces. Their names and their missions had never been revealed before. And we really feel that this put our guys in an unnecessary risk,” Hamburger said.

Many military experts at the time, including some of Obama’s top military advisers, had questioned the White House’s public praise of SEAL Team 6 and said it put members in danger.

Three months after bin Laden’s death, members of the SEAL Team 6 force – though apparently not the same ones who carried out the bin Laden raid — were on board the CH-47 Chinook transport helicopter, along with its Army National Guard aircrew, several support personnel and seven Afghan commandos. In all, 38 people died that night after the chopper was shot down by a Taliban-owned rocket-propelled grenade –or RPG – over the Wardak Province on Aug. 6, 2011.

Charles Strange, whose son Michael, 25, died in the attack said Obama personally promised him a thorough investigation of what happened but has failed to deliver.

Strange also blamed top military brass for sending the troops into a situation they were allegedly ill-equipped and unprepared to handle. The team was responding to an Army Ranger unit that was engaged in a firefight with the Taliban and needed backup.

Asked for comment, Pentagon spokesman Lt. Col. James Gregory said: “We share in the grief of all of the families who lost their loved ones.”

While not commenting directly on the allegations, he called those who were lost “warriors” who represented “the diversity and talent of America and its military.”

An official report was released in October 2011 but family members say it did little to fill in the details and left more questions than answers.

Karen Vaughn says she wants to know why her son Aaron and his team were not using special operations aircraft which have defenses in place to help allow helicopters to go deep behind enemy lines. The night her son Aaron died, he was in a helicopter that was built in the 1960s and last retrofitted in 1985.

An Opinion on the Renewed Push to Use the C-CPI for COLA, Inflation Indexing

The Chained-CPI (C-CPI) is a fully-substitution-based version of the CPI-U, which is the primary inflation measure published by the U.S. government’s Bureau of Labor Statistics. The C-CPI is designed to reduce the level of reported inflation that otherwise would be used by individuals to make decisions tied to their investments and income. As a vehicle for artificially reducing COLA adjustments for such programs as Social Security, its proposed use here appears to be a rare area of agreement between both sides in the current budget-deficit negotiations.

Those in the federal government who are honest and forthright with the American public—at least about the proposal to understate the official rate of inflation for purposes of budget reduction—have failed to drive a wooden stake through the heart of the C-CPI. Arising from its second, premature political burial, the C-CPI looks again like it has a strong chance of being used as a new federal parasite to drain consumer liquidity. Like a vampire bat that sucks only enough blood for self-nourishment—leaving its victims alive for further abuse—the use of the C-CPI as a cost-of-living adjustment (COLA) measure is designed to suck real disposable income from the limited cash-flow of Social Security recipients, for the benefit of politicians who do not have the guts to vote against Social Security.

Those receiving, or who will be receiving Social Security payments were forced to pay into the system for all of their working lives, and generally believed the U.S. government would treat them fairly and honestly. The bloodsuckers in Washington have hit their victims similarly, before, back in the 1980s with the introduction of hedonic-quality adjustments to inflation, and in the 1990s with the change of concept in the CPI to a quasi-substitution-based inflation measure. Previously, the CPI measured inflation for a fixed-weight basket of goods, which measured COLAs as an inflation adjustment needed to maintain a constant standard of living.

As noted earlier in this missive, these methodological changes have altered the CPI-U and its more narrowly defined variant, the CPI-W, so that they no longer measure those costs of maintaining a constant standard of living (substitution effects) and no longer measure out-of-pocket costs (hedonic-adjustment effects). Without the changes made to CPI calculations of the last several decades, Social Security payments would be more than double what they are today. Indeed, with the use of a substitution-based index (the C-CPI is fully substitution based), the resulting cost of living adjustments promise only a declining standard of living. Expanding the example that former Federal Reserve Chairman Alan Greenspan often used, where, as the price of steak rose, consumers would shift to hamburger, so too with higher hamburger costs have some cash-strapped retirees actually shifted consumption to dog food.

The President and Congress must address Social Security and other programs, such as Medicare, restructuring them so as make them solvent over the long haul, eliminating the horrendous levels of unfunded liabilities that are deteriorating at an aggregate pace in excess of $5 trillion per year on a net-present-value basis (see the Hyperinflation Report). With discussions instead focusing on using the outright deceit of implementing the C-CPI to cut COLA, those controlling the government appear to lack the political will to make needed changes in a straight-forward manner. Under those circumstances, there can be no meaningful budget deal structured by the negotiators in Washington.

The government must be honest with its citizens. If the government cannot afford to pay full COLAs, it is better to indicate that upfront, rather than to try to fool individuals as to the actual level of inflation they have to overcome in order to maintain their living standards. Cutting benefits by stealth and deceit may be politically expedient for the miscreants playing this game, but it is utterly unconscionable.

Beyond the damage caused by the C-CPI not reflecting out-of-pocket costs, and no longer measuring the cost of living of maintaining a constant standard of living, the C-CPI is not a practical measure for being used as a COLA or other benchmark inflation measure.

No Fixed Index Level for Reliable Cost Escalations in Contracts. As a separate issue, beyond the C-CPI not reflecting the cost of living of maintaining a constant standard of living or of reflecting full out-of-pocket consumer expenses, it cannot be published on a timely-enough basis to make it feasible as an annual-COLA factor.

The following graph shows the regular net revisions to year-to-year inflation in the Chained-CPI, published February 21, 2013 for the years 2011 and 2012. In contrast, the CPI-U and CPI-W never are revised on a not-seasonally-adjusted basis (barring an outright error in calculation).

That feature enables the use of the CPI-U and CPI-W as inflation-adjustment and cost-of-living-adjustment (COLA) measures in contracts, COLA adjustments to Social Security, etc. Although designed as a consumer-damaging, budget-cutting replacement for the CPI-W in goverment COLA adjustments, the C-CPI reporting is unstable, since it goes through regular revisions every year, for the two prior years. As shown in the following graph, the latest revisions would have suggested an upside revision of about three-tenths of a percentage point to any COLA adjustment would have been made previously for 2011.

As discussed by the BLS in its February 21, 2013 press release: “Because the current expenditure data required for the calculation of the C-CPI-U are available only with a time lag, the index is issued first in preliminary form, using the latest available expenditure data at the time of publication, and is subject to two subsequent revisions. Therefore, C-CPI-U indexes for the 12 months of 2011 [now] are issued in final form – employing monthly expenditure weights from 2011. Values for the 12 months of 2012 are revised and issued as interim, using expenditure weights from the 2009-2010 period. Calculation of the initial value of the January 2013 C-CPI-U index, and all subsequent months in 2013, will also be based upon 2009-2010 expenditure weights.”

Notes on Different Measures of the Consumer Price Index

The Consumer Price Index (CPI) is the broadest inflation measure published by the U.S. Government, through the Bureau of Labor Statistics (BLS), Department of Labor:

The CPI-U (Consumer Price Index for All Urban Consumers) is the monthly headline inflation number (seasonally adjusted) and is the broadest in its coverage, representing the buying patterns of all urban consumers. Its standard measure is not seasonally adjusted, and it never is revised on that basis except for outright errors.

The CPI-W (CPI for Urban Wage Earners and Clerical Workers) covers the more-narrow universe of urban wage earners and clerical workers and is used in determining cost of living adjustments in government programs such as Social Security. Otherwise, its background is the same as the CPI-U.

The C-CPI-U (Chain-Weighted CPI-U) is an experimental measure, where the weighting of components is fully substitution based. It generally shows lower annual inflation rate than the CPI-U and CPI-W. The latter two measures once had fixed weightings—so as to measure the cost of living of maintaining a constant standard of living—but now are quasi-substitution-based. Since it is fully substitution based, the series tends to reflect lower inflation than the other CPI measures. Accordingly, the C-CPI-U is the “new inflation” measure being considered by Congress and the White House as a tool for reducing Social Security cost-of-living adjustments by stealth.

The ShadowStats Alternative CPI-U Measures are attempts at adjusting reported CPI-U inflation for the impact of methodological change of recent decades designed to move the concept of the CPI away from being a measure of the cost of living needed to maintain a constant standard of living. There are two measures, where the first is based on reporting methodologies in place as of 1980, and the second is based on reporting methodologies in place as of 1990.

WASHINGTON – An interim report by House Republicans faults the State Department and former Secretary of State Hillary Rodham Clinton for security deficiencies at the U.S. diplomatic mission in Benghazi, Libya, prior to last September’s deadly terrorist attack that killed Ambassador Chris Stevens and three other Americans.

Senior State Department officials, including Clinton, approved reductions in security at the facilities in Benghazi, according to the report by GOP members of five House committees. The report cites an April 19, 2012, cable bearing Clinton’s signature acknowledging a March 28, 2012, request from then-U.S. Ambassador to Libya Gene Cretz for more security, yet allowing further reductions.

“Senior State Department officials knew that the threat environment in Benghazi was high and that the Benghazi compound was vulnerable and unable to withstand an attack, yet the department continued to systematically withdraw security personnel,” the report said.

Release of the report comes as dozens of House Republicans separately have pushed for Speaker John Boehner, R-Ohio, to create a select committee to investigate the Sept. 11, 2012, attack. The Associated Press obtained a copy of the report Tuesday.

The report also is highly critical of President Barack Obama and White House staff. In the days following the attack, White House and senior State Department officials altered what the report said were accurate “talking points” drafted by the U.S. intelligence community in order to protect the State Department.

And contrary to what the administration claimed, the alterations were not made to protect classified information. “Concern for classified information is never mentioned in email traffic among senior administration officials,” according to the 43-page report.

Last December, senior State Department officials acknowledged major weaknesses in security and errors in judgment that had been revealed in a scathing independent report on the deadly assault. Deputy Secretary of State William Burns and Deputy Secretary of State Thomas Nides admitted that serious management and leadership failures left the mission in Benghazi woefully unprepared for the terrorist attack.

Clinton, testifying before Congress in the final weeks of her tenure, took responsibility for the department’s missteps and failures leading up to the assault. But she insisted that requests for more security at the diplomatic mission in Benghazi didn’t reach her desk, and reminded lawmakers that they have a responsibility to fund security-related budget requests.

The report from the House committees is the latest broadside in what has been a long-running and acrimonious dispute between the Obama administration and congressional Republicans who have challenged the White House’s actions before and after the Benghazi attack.

House and Senate Republicans for weeks fought for access to information about the attack and used the nominations of two key Obama administration national security officials — Defense Secretary Chuck Hagel and CIA Director John Brennan — as leverage to obtain internal documents about the raid.

I was about a block away from the bombing and seeing people rushing from the scene and the panic on their faces is indescribable.

A lot of us didn’t know what was going on at first and our cell phones weren’t working. But unlike 9/11, everyone had access to social media and people were jumping on to Twitter and Facebook to see what was happening and connect with loved ones.

That’s still the case Tuesday. People are logging on and connecting with loved ones near and far as we all try to understand how and why this happened.

A Boston The deadly bombing at the Boston Marathon that killed at least two and injured more than 80 is believed to be an act of terrorism, senior White House officials told Fox News.

Two explosions tore through the finish line of the world-famous race just before 3 p.m., going off simultaneously as throngs of onlookers watched runners complete the 26.2-mile trek. The timing of the blasts immediately sparked suspicions of a deliberate act.

“When multiple devices go off, that’s an act of terrorism,” a senior administration official told Fox News, just moments after President Obama delivered a statement to the nation and did not use the word “terror.”

The official stressed that with details still coming in, it is unclear whether a foreign entity like Al Qaeda was behind it or whether it was home-grown terrorism. As a result, this official said the administration did not want the president to get out too far ahead and directly call it “terror.”

I really don’t understand this invented controversy. Since when has the tea party told people what they should think, what they should do, who they should listen to. Confronting bipartisan criticism, President Obama conceded Saturday his proposed budget is not his “ideal plan” but said it offers “tough reforms” to the nation’s benefit programs while closing loopholes for the wealthy, a mix that he argued will provide long-term deficit reduction without harming the economy.

In his first comments about a budget he is to release Wednesday, Obama said he intends to reduce deficits while at the same time providing new spending for public works projects, early education and job training.

“We don’t have to choose between these goals – we can do both,” Obama said in his weekly radio and internet address.

Obama’s budget calls for slower growth in government benefits programs for the poor, veterans and the elderly, as well as higher taxes, primarily from the wealthy. Some of its details, made public Friday, drew a fierce response from liberals, labor unions and advocates for older Americans and prompted an unimpressed reaction from Republican House Speaker John Boehner.

“It’s a compromise I’m willing to accept in order to move beyond a cycle of short-term, crisis-driven decision-making, and focus on growing our economy and our middle class for the long run,” Obama said.

Obama proposes spending cuts and revenue increases that would result in $1.8 trillion in deficit reductions over 10 years, replacing $1.2 trillion in automatic spending cuts that are otherwise poised to take effect over the next 10 years.

Counting reductions and higher taxes that Congress and Obama have approved since 2011, the 2014 budget would contribute to a total $4.3 trillion in total deficit reduction by 2023.

The key deficit reduction elements of the plan incorporate an offer Obama made to Boehner in December as both men sought to avert an impending “fiscal cliff” of automatic, across the board spending cut and broad tax increases.

Obama’s plan has two central features — $580 billion in new taxes that Republicans oppose and a new inflation formula, rejected by many liberals, that would reduce the annual cost of living adjustments for a broad swath of government programs, including Social Security and benefits for veterans.

In his address, Obama said he would achieve deficit reduction by making “tough reforms” to Medicare and by enacting “commonsense tax reform that includes closing wasteful tax loopholes for the wealthy and well-connected.”

Obama, however, made no mention of the effect his budget would have on Social Security and on other social safety net programs, a key feature of his proposal and one that drew hostile reaction from some of his most ardent political backers.

Obama rejected a House Republican budget that aims to balance the budget in 10 years with steep cuts in domestic spending. His remarks reflected the White House’s argument that Obama’s blend of tax increases and spending cuts have widespread public support and will ultimately change the terms of the fiscal debate in Washington.

“My budget will reduce our deficits not with aimless, reckless spending cuts that hurt students and seniors and middle-class families — but through the balanced approach that the American people prefer, and the investments that a growing economy demands,” he said.

Still, Obama has been unable to move House Republicans from their opposition to higher taxes. And his proposed reduction in the growth of benefits drew swift objections from allies.

“The president should drop these misguided cuts in benefits and focus instead on building support in Congress for investing in jobs,” AFL-CIO President Richard Trumka said in a statement Friday.

Kansas Gov. Sam Brownback delivered the Republican radio address, arguing that “the ideas on how to fix the federal government are now percolating in the states.”

“You see, you don’t change America by changing Washington — you change America by changing the states,” he said. “And that’s exactly what Republican governors are doing across the country — taking a different approach to grow their states’ economies and fix their governments with ideas that work.

Brownback, a former House member and U.S. senator, called for a “taxing structure that encourages growth, an education system that produces measurable results, and a renewed focus on the incredible dignity of each and every person, no matter who they are.”

ANNAPOLIS, Md. – Maryland’s already-strong gun laws will become among the strictest in the nation with a measure passed by the General Assembly Thursday, sending the bill to the Democratic governor who proposed the legislation in the aftermath of December’s massacre at a Newtown, Conn., elementary school.

The state Senate voted 28-19 for final passage, agreeing to a number of changes the House of Delegates approved Wednesday.

The measure would require people who buy a handgun to submit fingerprints to state police, bans 45 types of assault weapons, and limits gun magazines to 10 bullets. It also addresses firearms access for the mentally ill.

“Together, with a strong coalition of advocates, and the people of Maryland who overwhelmingly support policies to reduce gun violence, we’ve chosen to take action by advancing strategies that work to save lives,” Gov. Martin O’Malley said in a statement after the vote.

Maryland will become the first state in nearly 20 years to require potential handgun buyers to submit fingerprints to state police. Only five other states have a similar requirement: Connecticut, Hawaii, Massachusetts, New York and New Jersey.

Gun control advocates say the fingerprinting requirement will help keep guns away from criminals, because it will make people reluctant to buy firearms for those who are not allowed to have them. Opponents say the bill erodes Second Amendment rights and ultimately penalizes law-abiding citizens without focusing on lawbreakers.

Although the measure bans 45 types of assault weapons, people who own them now will be able to keep them. People who order the weapons before Oct. 1, when the law would take effect, also would be able to keep them.

People who have been involuntarily committed to a mental health facility won’t be allowed to have a gun.

Critics noted that Maryland already has strong laws, including universal background checks and a seven-day waiting period to buy a gun. The state doesn’t even have a loophole allowing for private sales at gun shows without the same background check that licensed dealers are required to obtain, said Sen. Allan Kittleman, R-Howard.

UN adopts pact to regulate multibillion-dollar global arms trade
The U.N. General Assembly has overwhelmingly approved the first U.N. treaty regulating the multibillion-dollar international arms trade.

The resolution adopting the landmark treaty was approved by a vote of 154 to 3 with 23 abstentions.

The 193-member world body voted after Iran, North Korea and Syria blocked its adoption by consensus at a negotiating conference last Thursday. The three countries voted “no” on the resolution.

The National Rifle Association has portrayed the draft treaty as a threat to gun ownership rights enshrined in the U.S. Constitution and has lobbied to defeat the proposal at the U.N. The NRA last week praised the Senate’s passage of an amendment to the Democratic budget proposal that would prevent the U.S. from entering into the treaty.

Four years ago Glenn talked about the machine progressives were building. The new framework that once ready, they would be able to turn on and fundamentally transform America. What does Glenn feel is THE most important piece of that machinery? Common Core. Using education to indoctrinate the youth has been embedded into the progressive agenda, with both the GOP and Democrats championing the terrifying legislation.

“I don’t know of a time that I have really truly called and put a plea out and sent an SOS out,” Glenn explained at the beginning of radio’s second hour today.

“This has already been done. This is way down the road. You’ll be lucky if it’s not in your school next fall, and it is an end run around your, not only around your state and its sovereignty, but it is an end run around your education department in your state, it is an end run around your board of education in your control community and most importantly it is an end run around you as a parent. It changes fundamentally our entire system. This is I believe the most important piece of fundamental transformation and you are going to hear a few things that you will find hard to believe, but I ask you today to please do your own homework. Do not take this at all from me. Do your own homework, and may I recommend you do it today and then you link arms with people and you get back into your 9/12 group.”

For weeks, Glenn has been exposing indoctrination in schools. It started with an expose on CSCOPE, which expanded to Common Core. It was during last week’s episode on Common Core that a guest discussed the scary amounts of data be collected on kids, and last night Glenn uncovered some of the scariest information on this topic yet.

“I’ve asked the experts, what other country is doing anything like this? The only one that’s even close, and it’s not in this ballpark, is China. There’s no one else in this ballpark. Our children are the guinea pigs for the world. We will lead the way. And do you remember when I said we wouldn’t be destroyed; we would be perverted? Profound darkness on this,” Glenn said.

“What I’m going to lay out for you, none of it is opinion; it all comes from government documents and all from either the stimulus package or from the Department of Education. But this is a hostile takeover, the final takeover, and the roots come from the stimulus package, although I believe George W. Bush started this ball rolling long ago in No Child Left Behind. And it really came from the idea of, ‘You want this money, you’re going to have to live by these standards.’ And that was what was in this stimulus package,” he explained.

The 2009 Stimulus Bill included provisions encouraging states to develop data systems for collecting a large amount of information on public-school kids. Today, all 50 states either maintain or are capable of maintaining extensive databases on public-school students.

“This is the summary of the stimulus package, HR 167 under Department of Education, “education for the disadvantaged” is what it says. And then it says for additional amount for education for the disadvantaged to carry out Title I of the elementary and secondary education act of 1965, $13 billion will be ‑‑ I’m going to have to count the zeros ‑‑ $13 billion will be provided. $5 billion shall be available for targeted grants under Section 1125 of ESEA, provided further that $5 billion shall be available for education finance incentive grants,” Glenn said.

“What that money again goes to in the stimulus, you know, 40 or 50 pages later: Improving collection and use of data. The State will establish a longitudinal data system that includes elements described in Section 604(e)(2)(d) of the America COMPETES Act. So you have to look that up. But that’s the key. If you want any money, you have to put together a data collection service. What is the data collection service? Well, this I contend is one of the reasons why we had the turtle tunnels and everything else that everybody talked about. Because it kept you away from things like this: $5 billion.”

“Now, Arne Duncan, the Secretary of Education, called this a historic opportunity. I call it bribery. Race to the Top gave the federal government billions of dollars to dangle in front of the cash‑starved states and they dangled and said, ‘All you have to do is sign up for this program. You’ll get the cash.’ And state after state signed.”

Glenn explained that 45 states have signed on but five have backed out, including Texas. However, in Texas they have replaced it with CSCOPE which is equally dangerous.

“But warning: Texas adopted another program almost exactly like it, and the GOP is protecting that program and so you have to be extraordinarily careful because they’ll just rename it. This is not a liberal agenda, this is not a conservative agenda, this is not Republican or Democrat. This is progressive. It is control. States signed up, and they had to develop data systems for collecting large amounts of information on public schoolchildren, and I mean large amounts,” Glenn said.

“These databases will track all kinds of personal data, including but certainly not limited to healthcare histories, income information, the religious affiliation of your family, voting family status, blood types, blood test result, homework completion, hair color, eye color, whether a child was premature or not, do they have any birthmarks, even bus stop arrival information. It goes deep, deep. If they have 44 data points, they can tell you an awful lot about ‑‑ they can tell you just pretty much anything. These are hundreds of data points collected on your children for over 20 years. This is the groundwork for a national student database that will track your kids and their personal information from preschool until the stated end of 20,” Glenn said.

“What Common Core and this data collection system really is, the easiest way to understand it, and this is my personal understanding and my personal opinion. I want to separate fact from my opinion so you’re very clear. But the best way I think to describe it is, you know how China goes in and they find the kids that have the most talent for gymnastics and they’ll say, that kid’s going to be fantastic as a gymnast. That kid is a great mathematician. He’s going to work in our nuclear power programs. That’s what happens. By the time you’re 7, your lot is cast,” Glenn explained.

“That’s exactly what this is and that’s why these corporations want this so much. Because they will cast the lots, they will find the best workers by the time they’re 7 and then they will enrich and empower and educate those kids. But if your kid, God forbid, ends up like me when I was 7 or 8, I don’t have a chance. I will be a cog in the machine forever, and you will ‑‑ there will be no escape. There will be no college education.”

“What you will see is state capitalism. Google, Microsoft, GE, data mining our schools to nudge our children into the job the State deems the most needed for the future,” Glenn warned.

GE is one of the companies funding Common Core through it’s foundation.

Now, most parents would assume that any information collected on their kids by the schools would be protected by some kind of privacy laws, right? Not anymore.

Glenn explained last night:

The Family Educational Rights and Privacy Act used to protect the privacy of kids and a parents written consent was needed to release data. But in 2012, regulations were used to change the need to get parental consent. Now all the information the schools started collecting in 2009 can be shared among various federal agencies and without consent as long as whoever requests it is “conducting certain studies for or on behalf of the school”. According to the National Data Collection Model, the government should collect information on health-care history, family income and family voting status along with religious affiliation and extra curricular activity, and more.

Glenn warned that when fighting back and spreading the word about Common Core, there is a good chance that concerned parents will be treated like conspiracy theorists. Already in Oregon, parents who pushed back on the program were portrayed as kooks who were anti-science.

A Benghazi0 Republican Sen. Lindsey Graham, in an interview with Fox News, alleged that the injured survivors of the Benghazi terror attack have been “told to be quiet” and feel they can’t come forward to tell their stories — escalating his push for more information about survivors who have never been publicly identified.

The White House is denying any attempt to exert pressure on them.

“I’m sure that the White House is not preventing anyone from speaking,” White House Press Secretary Jay Carney said, when asked about the survivors.

But Graham told Fox News, “the bottom line is they feel that they can’t come forth, they’ve been told to be quiet.”

“We cannot let this administration or any other administration get away with hiding from the American people and Congress, people who were there in real time to tell the story,” Graham said.

Graham continued to voice concern about the inaccurate or incomplete accounts that came from the Obama administration in the days following the attack. He is among a handful of Republican lawmakers pressing for access to and more information about the survivors.

A congressional source tells Fox News that Hill staffers investigating the attack believe about 37 personnel were in Benghazi on behalf of the State Department and CIA on Sept. 11. With the deaths of Ambassador Chris Stevens and three others, about 33 people were evacuated. Of them, a State Department official confirmed there were three diplomatic security agents and one contractor who were injured in the assault – one seriously.

A diplomatic security source told Fox News the State Department diplomatic security agent who was in the most serious condition suffered a severe head injury during the second wave of the attack at the annex.

This agent was described as the likely State Department employee visited at Walter Reed Medical Center by Secretary of State John Kerry in January.

While not denying the details, the State Department official offered no comment on the nature of the injuries or whether the agent was visited by Kerry or Hillary Clinton before she left office.

Leading Republicans in the Senate and House have been calling on the State Department to identify the injured and make them available to congressional investigators. So far, they say their calls have gone unanswered.

Rep. Jason Chaffetz, R-Utah, said the administration has provided “zero” documents on the matter and has not provided names of those attacked.

Rep. Frank Wolf, R-Va., has gathered about 60 signatures in support of a select committee to investigate the Benghazi terrorist attack. Wolf has said the committee is the most thorough and efficient approach to resolving the lingering underlying questions rather than the competing and overlapping committee jurisdictions.

Wolf, along with Rep. Dana Rohrabacher, R-Calif., and leading Senate Republicans Graham, John McCain of Arizona, and Kelly Ayotte of New Hampshire have pressed the State Department for answers.

Rohrabacher, R-Calif., on Friday said the administration is “covering up something.”

1aaa Three diplomatic security agents, as well as a State Department contractor, were among the Americans injured during the terrorist attack last September on the U.S. Consulate in Benghazi, Fox News has learned.

According to a State Department official, who confirmed Fox’s reporting on the condition of anonymity, two diplomatic security agents were injured, including one “seriously,” at the CIA facility known as the “annex” and a third suffered smoke inhalation at the consulate where Ambassador Chris Stevens was killed.

Four Americans, including the U.S. ambassador, were killed in the attack, and the Obama administration faced intense criticism from Republicans in the aftermath over security problems and apparent inconsistencies in officials explanation of what happens. Lately, however, the focus has turned to the attack’s survivors, who still have not been named.

Separately, a diplomatic security source told Fox News the State Department diplomatic security agent who was in the most serious condition suffered a severe head injury during the second wave of the attack at the annex from mortar and rocket-propelled grenades.

This agent was described as the likely State Department employee visited at Walter Reed Medical Center by Secretary of State John Kerry in January — a visit first confirmed by Fox News’ James Rosen in a recent interview with Kerry.

Many of you will remember a story I broke a long time ago – about presidential candidate Barack Obama’s little-noticed announcement that, if elected in 2008, he wanted to create a “civilian national security force” as big, as strong and as well-funded as the Defense Department.

Here’s what he actually said at a campaign stop in Colorado July 2, 2008: “We cannot continue to rely on our military in order to achieve the national security objectives we’ve set. We’ve got to have a civilian national security force that’s just as powerful, just as strong, just as well-funded.”

Could what we see happening now in the Department of Homeland Security be the beginning of Obama’s dream and our constitutional nightmare?

We’ve learned more about Obama’s vision since then. Maybe it’s time for a review:

He made the campaign promise to build this $439 billion domestic army, but all references to the initiative were inexplicably deleted from the copy of his speech posted on his website while others mysteriously disappeared from transcripts of the speech distributed by the campaign. That was strange – and ominous.
At the time, I had never heard anyone use the phrase “civilian national security force” before. But I did a little homework and found out where it originated. It was first proposed by then Bush administration Defense Secretary Robert Gates. On that basis alone, I accurately predicted that, if elected, Obama would name Gates as his own defense secretary. Needless to say, when that appointment came to pass, no media outlet bothered to interview me about my foresight.
Still during the campaign of 2008, I suggested that what Obama had in mind might be something very sinister indeed – perhaps “some kind of domestic Big Brother program.”

We never heard another mention of Obama’s “civilian national security force” again. Not in 2008, 2009, 2010, 2011 or 2012.

But that brings us up to 2013 and the highly unusual stockpiling of firearms and ammo by Homeland Security – firearms and ammo that Obama would like to deny to ordinary citizens who are not members of his domestic army.

Well, I hate to say it, but I may have predicted this, too.

In a Halloween column last fall, I stated that, if re-elected, Obama would “declare a full-scale war on his domestic opposition.”

I wasn’t joking. I was deadly serious – so serious, in fact, that I did something I pledged I would never do: Vote for Mitt Romney. It was a matter of self-defense and self-preservation. I said then that a second term of Obama might mean we would never see another free and fair election in America. (I’m not even sure we saw one in 2012.) I suggested due process would go the way of the horse and buggy. I said I expected Obama would move to shut down or destroy all independent media. I even speculated that his biggest critics would eventually be rounded up in the name of national security.

Think about it.

Why does the civilian Department of Homeland Security need billions of rounds of ammunition?

This is the agency that is responsible for policing the border. But it doesn’t.

This is the agency that is responsible for catching terrorists. But it doesn’t.

So why does Homeland Security need so many weapons and enough hollow-point rounds to plug every American six times?

Maybe this is the “civilian national security force that’s just as powerful, just as strong, just as well-funded” as the Defense Department.

These words – “civilian national security force” – have haunted me ever since I first read them.

Obama has never explained what he meant.

He’s never been called to account for that remark.

Doesn’t this sound like police-state talk to you?

The U.S. Army alone has nearly 500,000 troops. That doesn’t count reserves or National Guard. In 2007, the U.S. defense budget was $439 billion. No one knows what the budget is today because Congress stopped passing budgets when Obama took office.

Is Obama serious about creating some kind of domestic security force bigger and more expensive than that? Is this part of his second-term agenda?

He has also set up, as I have reported, a new homeland security bureaucracy to operate under his own direction.

I think it’s worth recalling here that just over a year ago both houses of Congress unwisely passed the defense reauthorization bill that killed the concept of habeas corpus – legislation that authorized the president to use the U.S. military to arrest and indefinitely detain American citizens without charge or trial.

That legislation would empower a lame-duck Obama to use all of the power of the federal government – constitutional and unconstitutional – to target his political enemies.

If any Republican, conservative, independent journalist, pro-life activist, returning veteran, gun-rights activist, constitutionalist, Bible believer or critic of Obama thinks they will be safe in a second term under this would-be despot, they had better think again – real fast.

The “civilian national security force” is not here to protect any of them. It’s here to destroy the opposition. It’s here to destroy liberty. It’s here to destroy the Constitution.

WASHINGTON – A federal court’s ruling Friday that President Obama violated the Constitution with recess appointments to the National Labor Relations Board opened the door to claims that a host of rulings and other past appointments may be in question, as the White House blasted the decision as unfounded.

The administration is expected to appeal. Though White House Press Secretary Jay Carney would not confirm that, he called the ruling “novel and unprecedented.”

“It contradicts 150 years of practice by Democratic and Republican administrations. So we respectfully but strongly disagree with the ruling,” Carney said.

He denied that the ruling would have any bearing on other decisions and appointees. “This is one court, one case, one company,” Carney stressed.

But Republican lawmakers who have railed against the administration’s recess appointments, as well as the often union-favoring decisions of the NLRB, rejected that view.

“Today’s ruling will certainly cause other opinions unconstitutionally issued by the board to be invalidated,” Rep. Darrell Issa, R-Calif., said. “The unconstitutionally appointed members of the NLRB should do the right thing and step down.”

He also urged the NLRB to take the “responsible course” and stop issuing decisions “until a constitutionally sound quorum can be established.”

The quorum issue is critical, as the NLRB only has three members — the typically five-member board is only allowed to issue decisions when it has at least three members. The court decision pertained to three separate appointees, two of whom are still on the board. If those two left, there would be just one validly appointed member — effectively shutting the board down.

If the decision stands, it could also invalidate hundreds of board decisions made over the past year.

The ruling also threw into question Obama’s recess appointment of Richard Cordray to head the Consumer Financial Protection Bureau. Cordray’s appointment, made in early January along with the three NLRB appointments in question, has been challenged in a separate case.

“The recess appointments are invalid,” C. Boyden Gray, former White House counsel to former President George H.W. Bush, said in a statement. He said the questions surrounding Cordray also cast “serious doubt” on the actions taken by the Consumer Financial Protection Bureau.

Carney and the NLRB claimed the case would not affect the board’s operations.

NLRB Chairman Mark Gaston Pearce said the board “respectfully disagrees with today’s decision and believes that the president’s position in the matter will ultimately be upheld.”

He said “we will continue to perform our statutory duties and issue decisions.”

Carney also cited “280-plus intra-session recess appointments” dating back to 1867, suggesting the court ruling flies in the face of this history.

The suit had been brought by a local business in Washington state challenging the National Labor Relations Board. Supported by dozens of Senate Republicans, the case argued the president didn’t have the power to make three appointments to the NLRB.

Attorneys for the Obama administration argued that he had the authority because the Senate was away for the holidays on a 20-day recess. The Constitution allows for such appointments without Senate approval when Congress is in recess.

But during that time, GOP lawmakers argued, the Senate technically had stayed in session because it was gaveled in and out every few days for so-called “pro forma” sessions.

GOP lawmakers used the tactic — as Democrats had done in the past – specifically to prevent the president from using his recess power to install members to the labor board. The White House argued that the pro forma sessions — some lasting less than a minute — were a sham.

But the three-judge panel for the Court of Appeals in the District of Columbia said the appointments were not valid. The judges, all appointed by Republican presidents, ruled that during one of those pro forma sessions on Jan. 3, the Senate officially convened its second session of the 112th Congress, as required by the Constitution.

“Either the Senate is in session, or it is in the recess. If it has broken for three days within an ongoing session, it is not in ‘the Recess,’” the panel said.

The court said the president could only fill vacancies with the recess appointment procedure if the openings arise when the Senate is in an official recess, which it defined as the break between sessions of Congress.

“Considering the text, history and structure of the Constitution, these appointments were invalid from their inception,” a panel said.

Republican lawmakers lauded the decision.

“Today’s ruling reaffirms that the Constitution is above political party or agenda, despite what the Obama administration seems to think,” Sen. Orrin Hatch, R-Utah, said. “With this ruling, the D.C. Circuit has soundly rejected the Obama administration’s flimsy interpretation of the law, and will go a long way toward restoring the constitutional separation of powers.”

In early January, Obama appointed Deputy Labor Secretary Sharon Block, union lawyer Richard Griffin and NLRB counsel Terence Flynn to fill vacancies on the NLRB, giving it a full contingent for the first time in more than a year. Block and Griffin are Democrats, while Flynn is a Republican. Flynn stepped down from the board last year.

Democrats introduce expanded assault-weapons ban

Congressional Democrats introduced a new and broader assault-weapons ban Thursday, in a vivid press conference that included a display of various weapons they want to outlaw.

It was a measure that was quickly condemned by the National Rifle Association as an assault on the Constitution, “instead of prosecuting criminals or fixing our broken mental health system.”

“The American people know gun bans do not work and we are confident Congress will reject Senator Feinstein’s wrong-headed approach,” spokeswoman Andrew Arulanandam said.

The measure was written by Democratic Sen. Dianne Feinstein, who was behind the original 1994 assault-weapons ban which expired in 2004. It marks the first major legislative step since President Obama, in the wake of the Newtown school shooting, called for new gun control measures including a new and stronger assault-weapons ban.

“Our weak gun laws allow these mass killings to be carried out again, and again, and again in our country,” Feinstein said. “Weapons, designed originally for the military to kill large numbers of people in close combat, are replicated for civilian use.”

She said the bill she and her colleagues are introducing would bar the “sale, transfer, manufacture and importation” of assault weapons. It would also ban magazines that hold more than 10 rounds.

As part of the press conference, lawmakers displayed an array of weapons, including a Colt AR-15, a semi-automatic assault rifle, and an Intratec TEC-9, a semi-automatic handgun.

The move comes after NBC News host David Gregory faced an investigation for displaying a banned magazine on a Sunday show in the District — but the Senate sergeant-at-arms office said the weapons were displayed Thursday in “compliance” with all applicable laws.

The office said they are “authentic” and in the custody of the Philadelphia and D.C. police departments, which brought them.

The weapons ban, though, faces long odds even after last month’s mass school shooting in the state of Connecticut.

In a statement, Republican Texas Sen. Ted Cruz said the proposal would have done “nothing” to prevent the Newtown tragedy and vowed to fight to defeat the bill.

“Washington politicians shouldn’t be taking advantage of recent tragedy to try to push an aggressive gun control agenda. Real assault weapons — machine guns — are already functionally illegal, and they have been since 1934,” he said.

The last ban expired in 2004 when Congress refused to renew it under pressure from the National Rifle Association, a gun advocacy group. There’s continuing disagreement about the effectiveness of the original assault-weapons ban, and measures like beefed-up background checks on gun sales may be more likely to pass.

Definitions of what qualifies as an assault weapon have varied over time and across states.

According to a summary from Feinstein’s office, her bill would place bans on 120 “specifically named firearms,” as well as certain other semiautomatic guns — and those with a fixed magazine that can hold more than 10 rounds.

While the 1994 law defined an assault weapon as one that had, in most cases, a detachable magazine and at least two characteristics as set by Congress, the new bill would define an assault weapon as one that meets just one of those characteristics.

Some of those characteristics for rifles in the old law included a pistol grip, a folding stock and a bayonet mount. But the Feinstein bill would strip what her office describes as “easy-to-remove” characteristics like the bayonet mount from that list.

Feinstein’s office says the bill would grandfather in weapons legally owned before enactment and exempt more than 900 “specifically named weapons” for hunting or sporting purposes.

Benghazi More than four months after the deadly attack on the U.S. diplomatic compound in eastern Libya, Secretary of State Hillary Clinton will deliver long-awaited testimony on the historic security failure.

The secretary, after missing prior sessions before Congress due to illness, is set to take lawmakers’ questions Wednesday before a House and Senate committee. As Clinton prepares to leave the department after a busy four years, the hearing is a chance to address what is arguably the biggest controversy of her tenure.

“There’s no question there hasn’t been the accountability within the department,” Sen. Bob Corker, R-Tenn., the incoming top Republican on the Senate Foreign Relations Committee, told Fox News. “I think this is going to be the beginning, I hope … of a top-to-bottom review.”

Congress has already held multiple hearings to date, with lower-level officials testifying, on the Benghazi attack. The administration has gradually backed off its position that the attack was spontaneous — an assertion that drew the ire of congressional lawmakers who said it was clearly planned. An official State Department-sanctioned report has resulted in several officials leaving their current posts, after finding “systemic failures” left the Benghazi compound inadequately protected.

The hearing Wednesday, though, is a forum for lawmakers to question Clinton on what she might have known about requests for security at the Benghazi post – and what she thinks should be done to improve security going forward, as she prepares to leave the department. Sen. John Kerry, D-Mass., has been nominated to replace her.

State Department spokeswoman Victoria Nuland said Tuesday “there was no question” that Clinton “considered it her responsibility to learn the lessons from this, and to take the department forward in implementing whatever lessons were learned.”

There are also questions about how the Obama administration responded to the crisis during the Sept. 11, 2012 attack. Fox News has learned from senior U.S. defense officials that a FAST team of Marines out of Spain was asked by State Department officials to change out of their Marine uniforms after being asked to leave for Libya to help — this required them to deplane and delayed them by about 90 minutes, according to Pentagon officials.

Then there is the decision by Clinton and State Department Undersecretary of Management Patrick Kennedy not to mobilize the Counterterrorism Security Group, which is composed of experts on terrorism from across government agencies and makes recommendations to the deputies who assist the president’s Cabinet in formulating a response to crises involving terrorism.

Further, there are questions about the perceived delays CIA officials – stationed in Benghazi — encountered that night and their frustration that air support was not sent from nearby Sigonella air base. In recent weeks, Fox News has learned that the rescue unit that left Tripoli was told that “fast fliers” — or air support — would be above when they landed in Benghazi. They weren’t.

Still, the department’s review board concluded: “The Board members believe every possible effort was made to rescue and recover Ambassador Chris Stevens and Sean Smith. The interagency response was timely and appropriate, but there simply was not enough time for armed U.S. military assets to have made a difference.”

Lawmakers have waited months to ask Clinton direct questions about the Benghazi attack, in which U.S. Ambassador Chris Stevens and three other Americans were killed. That attack, though, may just be the starting point for Wednesday’s hearings amid mounting questions about the hostage crisis in Algeria and the French-led military campaign in neighboring Mali.

Corker told Fox News “there’s going to be a lot of questions about just the overall policies of this administration as it relates to” Al Qaeda’s affiliate in North Africa.

An Al Qaeda-tied operative has claimed responsibility for the attack at a gas plant in Algeria that left 37 hostages dead, including three Americans.

Corker suggested the developments challenge an administration that was “spiking the ball on Al Qaeda” last year as the U.S. chipped away at the group’s leadership in Pakistan and Afghanistan, and took out Usama bin Laden the year before that.

“That’s where the core of Al Qaeda (is), but there are all these nodes that are scattered through Africa now that obviously are a threat to Western civilization, and it’s as if they’ve taken their eye off the ball,” Corker said.

Clinton was preparing to testify in December, but fell ill and was unable to address Congress.

The State Department has thus far been sparing in its explanation of the separate Algeria attack.

Nuland said last week that Clinton spoke with the Algerian Prime Minister and “talked about the challenge that Algeria has had historically with terrorism.”

Clinton later said “it is absolutely essential that we broaden and deepen our counterterrorism cooperation going forward without Algeria and all countries of the region.”

She said she made clear to the prime minister that “we stand ready to further enhance the counterterrorism support that we already provide.”

Outgoing Defense Secretary Leon Panetta also had tough words, saying those who try to attack Americans “will have no place to hide.”

On the House Foreign Affairs Committee, an aide to Rep. Michael McCaul, R-Texas, also said it’s likely the Algeria hostage standoff will come up Wednesday.

Clinton plans to testify on the Senate side at 9 a.m. ET Wednesday, and at 2 p.m. on the House side.

Obama vows to ‘vigorously pursue’ gun control, prepares to release proposals

President Obama says he plans to make public later this week the details of his plan to tighten firearms laws based on the findings of a White House task force he commissioned in the aftermath of the fatal Connecticut school shooting.

The task force was led by Vice President Joe Biden and held its final White House meeting Monday, talking with members of the House Democratic Gun Violence Prevention Task Force.

A source told Fox News that Biden explained at the meeting that he and his staff have researched various plans of action to reduce and prevent gun violence and have identified 19 different options the president could choose to implement through executive order.

Obama said Monday he planned to review the findings and will “vigorously pursue” the recommendations in the next few days. It’s unclear how many of the 19 options the president would eventually take up.

The president vowed after the Dec. 14 massacre at Sandy Hook Elementary School in Newtown, Conn., that he would look for ways to curb gun violence, including possible legislation to ban assault weapons and high-capacity ammunition clips like those used in the attack, which killed 20 first-graders and six adults at the school.

Among the other potential proposals is tightening background checks on prospective gun buyers. The president said Monday some of his goals could be accomplished through legislation, while others could be done through executive action.

The White House meeting Monday included Attorney General Eric Holder, Homeland Security Secretary Janet Napolitano and Health and Human Services Secretary Kathleen Sebelius, who have participated in several other talks.

“Our task force looks forward to working with … the Obama administration and all stakeholders to enact a comprehensive set of proposals that both respects the 2nd Amendment rights of law-abiding citizens without a history of dangerous mental illness and helps keep our schools, streets and communities safe from gun violence,” said California Rep. Mike Thompson, chairman of the eight-member House task force.

Biden already has talked with individuals and groups supporting tougher guns laws, including the Brady Campaign, and gun rights groups, including the National Rifle Association, which opposes any legislation to again ban assault weapons and high-capacity clips. Biden also has spoken with governors and executives with the video-gaming industry.

Obama has suggested he will submit legislation after his Jan. 21 inauguration and Congress’ return to Washington.

As gun and ammunition sales across the United States skyrocket and store shelves are emptied of just about anything related to weapons and accessories that may soon be banned by the Federal Government, some of America’s largest and most well known corporations are starting to take sides. Reports have been streaming in over the last few weeks indicating that retail giant Walmart may be standing against the Second Amendment of the U.S. Constitution and that their corporate headquarters has taken steps to restrict the availability of ammunition.

The following is an alert sent by a reader toSteveQuayle.com:

I’ve read various postings on message boards claiming local Wal-Mart managers told customers they are no longer permitted to reorder ammo inventory. I can confirm this is true.

I went to Wal-Mart today in our town to buy ammo. The case was almost empty. I asked the store manager when new supplies will arrive.

He said, “Corporate headquarters notified all local managers that we can not order any more ammo until further notice.”

Do Wal-Mart executives know that Piers Morgan doesn’t shop at Wal-Mart, but millions of middle class American families are the source of their wealth? What happens to Wal-Mart’s earnings if Middle Class America boycotts Wal-Mart for caving in to Obama?

I’ve always suspected the gun grabbers would cut off ammo supplies first. They’re doing it now. Next, they will use strong arm tactics to shut down ammo manufacturers. You’ll have a gun, but no bullets to load in it. It’s only the beginning of the communist agenda. This plan was prepared a long time ago. The commies are pushing hard and fast. They plan to overrun a confused and bewildered public that can’t fathom that a genuine communist takeover is underway.

Last week, Bank of America chose to stand with the anti-gun movement when they froze the funds of a licensed online gun retailer, reportedly telling the owner of American Spirit Arms that he, “should not be selling guns and parts on the internet.”

Supporters of the Second Amendment, however, are speaking with their wallets, having lambasted Bank of America for their actions, with many claiming they were closing their accounts immediately.

When one of the largest online sporting goods stores in the world, Cheaper Than Dirt, suspended the sale of firearms after mounting pressure from anti-gun groups and the government, thousands of comments from disgruntled customers – many of them now ex-customers – overwhelmed the company’s Facebook page.
