Immigration agents file suit against Napolitano over ‘amnesty’ program

Ten federal immigration agents have filed suit against Homeland Security Secretary Janet Napolitano claiming recent directives are forcing them to break the law and ignore their duties when it comes to deporting illegal immigrants. The suit was filed Thursday in Texas federal court by Immigration and Customs Enforcement officials. It challenges recent directives allowing some illegal immigrants — particularly non-felons and those who came to the U.S. as children — to stay and, in some cases, get work permits.

The suit, obtained by Fox News, says the agents are being forced to “violate federal law.” It says the new directive “unconstitutionally usurps and encroaches upon the legislative powers of Congress.” ICE Director John Morton is also named as a defendant. Kris Kobach, lead attorney on the case, equated the move to give thousands of illegal immigrants a reprieve to the failed Fast and Furious gun-walking operation. “In both instances, the Obama administration ordered federal law enforcement agents to break the law, to ignore the laws that they’re supposed to enforce, and, in the case of the ICE agents, to actually break federal laws that say you’re supposed to deport certain people,” he said. “And in each case, the Obama administration seems to be doing so for political reasons.” Kobach, the Kansas secretary of state, is also an adviser to Mitt Romney and a co-author of the Arizona illegal immigration law. Napolitano defended the new rules during testimony last month before the House Judiciary Committee. “These policies promote the efficient use of our resources ensuring that we do not divert them away from the removal of convicted criminals by pursuing the removal of young people who came to this country as children and who have called no other country home,” she said. The Supreme Court has recognized the ability of the federal government to use what’s known as “prosecutorial discretion” in the enforcement of immigration law. In the recent case over the Arizona immigration law, the court defended the government’s ability to make “some discretionary decisions.” In the suit, the agents are asking a federal judge to block the directives in question, saying they amount to an end-run around Congress and violate the separation of powers between the Legislative and Executive branches. Republican lawmakers released a flurry of statements Thursday backing up the suit and challenging the administration policy. “The Obama administration’s amnesty program not only rewards lawbreakers, it also forces ICE agents to violate federal law. ICE agents should enforce our immigration laws and apprehend illegal immigrants. But the Obama administration makes it impossible for ICE agents to do their jobs,” House Judiciary Committee Chairman Lamar Smith, R-Texas, said in a statement.

Texas Congressman Louie Gohmert, Mass Tea Party’s Keynote Speaker at our April 15th Patriot Courage Rally, minced no words with Fox Business’s Liz MacDonald. He charged that the Obama  “Administration’s Immigration Policy [is]  Adding to [our national] Crime Rate.”  As we all understand by now, the Obama Administration is more concerned with garnering votes than they are with keeping illegal immigrant Level I, II and III felonious murderers, rapist and kidnappers in prison. After all, they need another term to complete their disintegration of America and our institutions.

W observed the same behavior in our state during Obama- lite,  Deval Patrick’s  scheme to delay and sabotage  the ability of cities and town’s to implement  the Federal Secure Communities  program. A program, that at virtually no cost to the state, cities or towns would have identified the same felonious   criminals and  would have subjected them to deportation after serving time for their crimes. We must hold this administration morally and criminally responsible for every inhabitant of our country that is brutalized by these felons.

MILFORD (FOX 25 / MyFoxBoston.com) – Three brothers, all illegal immigrants from Ecuador, are now all accused of serious crimes.

David Segundo Dutan-Guaman who is the latest brother to be accused reportedly stabbed a 21-year-old man in the arm with a kitchen knife during an argument at a house party. The incident occurred early Saturday morning at Dutan-Guaman’s home on Water Street.

The victim hurt so badly, he left this trail of blood stretching for a block; however, Chief Thomas O’Laughlin of the Milford Police told FOX 25, that although it was a “pretty severe cutting” the victim is expected to survive.

If the Dutan-Guaman name sounds familiar, it is because David’s brother Nicolas Dutan-Guaman, is accused of hitting and killing 23-year old Matthew Denice in Milford last August.

A third brother, Pablo, is accused of letting Nicolas drive his truck even through he did not have a license.

Wendy Murphy, the lawyer for the Denice family, said “what’s frustrating for them is here’s yet another case from the same family involving circumstances somewhat similar to those that led to Matthew’s death.”

Denice’s high-profile death shed light on Gov. Deval Patrick’s refusal to sign onto the Secure Communties Program which is the federal government’s fingerprint sharing program meant to identify and deport criminal illegal immigrants.

Authorities say knowledge of David Dutan-Guaman prior arrests would not have made a difference in this case unless Secure Communities had been in place previous to his arrest allowing immigration authorities to learn about him.

The Denice family’s attorney believes the governor should have signed on when he had the chance.

“It’s hard to imagine that a politician would be opposed because all it is is a kind of one stop shopping for law enforcement officials that want to know as much as they can about the people they’re pulling over, the people they’re arresting,” said Murphy.

A spokeswoman for Gov. Patrick told FOX 25 that they would not be speaking about it because it is a local and federal law enforcement issue.

Even though the governor has refused to sign onto Secure Communities, it is still coming. The federal government is planning to roll out the program nationwide, including right here in Massachusetts, by the end of 2013.

As for David Dutan-Guaman, he is being held on $5,000 bail.

A law enforcement official with knowledge of the case says ICE has lodged a detainer against Dutan-Guaman which means if he is released, ICE would move in and take custody.

The Mayor of New Haven, CT has announced that he hopes to ask the state legislators to allow illegal aliens in his city to be granted the right to vote.

Why is John DeStefano Jr. pressing for a change in the law that would allow people living illegally in the country (and his city) to vote?

He says “to build a more engaged participatory community”

The New Haven Register reports that the change to the law could bring a substantial pool of new voters to DeStefano’s camp. The paper estimates as many as 12,000 undocumented people are living in the New Haven area.

That begs the question: Is there another motive besides building “a more engaged participatory community” behind DeStephano’s idea? Possibly.

Just last month Mr. DeStefano was re-elected to a record 10th term as mayor of New Haven, but the margin of victory was not that large. Of the estimated 64,000 registered voters in the city, fewer than 15,000 participated in the last election.  Adding a potential pool of 10-12,000 new voters could make certain that DeStefano doesn’t face such a problem in the future.

The paper also reports that DeStefano’s point of view includes this statement:

“If you live here, you pay taxes here and send your kids to school here, you should be able to vote.”

Curiously, the Mayor equates paying rent (living here) to paying taxes, and therefore that justifies the right of a person to vote — no matter their citizenship status.

Northern California Police Recognize Mexico IDs

Two law enforcement agencies in northern California will start accepting Mexican consular cards as a valid form of identification to help reduce the number of deportations in the area and lower the number of people jailed for minor offenses, The Santa Rosa Press Democrat reported.

“Today is a great day,” Lorenzo Duenas, an assistant sheriff in Sonoma County told an energized Santa Rosa high school auditorium decorated with Mexican blankets, according to the paper. “We’re now going to accept the matricular consular ID.”

Under the former policy, a Mexican national without proper ID could be jailed without ever being convicted of an offense. To be sure, after being fingerprinted, they would remain incarcerated until being handed over to immigration agents, the paper reported. Under the new policy, Mexican nationals with the ID would be allowed to go free as long as  they’re not suspected of any other offense.

The multiagency decision was greeted warmly by the Mexican community in the area that in recent years watched families break apart because of non-criminal deportations, Leticia Romero, the vice president of the North Bay Organizing Project, said.

“It’s important for a community to feel safe where they live,” she told FoxNews.com. “The fear of being pulled over on your way to work could be difficult.”

The Mexican consulate will likely open locations in the area to help individuals apply for the cards.

Romero said the new policy will likely be established in January, and anyone arrested and processed under the old law would be unaffected by the change.

Three sheriffs push for federal Secure Communities program

Deval Patrick and his Minions propagation of the myth that the Secure Communities program was deporting illegal aliens with noncriminal records has been clarified by ICE.

“Federal immigration officials released new statistics last week to bolster their assertion that the agency is focusing on deporting criminals and, in another priority, on flagrant violators of immigration law.

According to the figures, which cover October 2008 to July 31 of this year, 52 percent of the 369 immigrants deported from Boston were convicted criminals.

About 48 percent of the deportees had no prior criminal record. But the agency provided new details that showed for the first time that most noncriminal deportees were more serious violators of immigration law, including 68 people with outstanding deportation orders and 49 people who allegedly returned to the United States after having been deported - a felony offense, though they were not convicted of it.

The remaining 60 noncriminal deportees had allegedly crossed the border illegally or overstayed their visas. The federal agency has touted Secure Communities as an initiative that could make cities and towns safer.

Federal officials said that the program helped find Joao Brito in Boston, who was wanted in his native Netherlands on charges of human smuggling and sexual abuse of children.”

The ICE clarification confirms testimony presented by Jessica Vaughan an expert on , Director of Policy Studies at the Center for Immigration Studies, to Governor Patrick’s public safety Secretary, Mary Beth Heffernan. Testimony that was ignored when the governor caved in and blocked Secure Communities implementation in MA.

Governor Patrick  even now continues his deception with his statement that  “…he is concerned Secure Communities could lead to ethnic profiling” . This though he full well knows that the FBI policy related to him is to forward  solely  fingerprints to ICE for identification. That’s right, no photos, no physical or ethnic description for everyone arrested.

Phoenix-based Nuestros Reconquistos claims that there will be a war very similar to the Civil War fought in the next five years. “La Raza and MEChA have already talked to Latinos and Phoenix and explained that Latinos need to arm themselves for war,” says Nuestros Reconquistos President Manuel Longoria.

Cecilia Maldonado of Chicanos Unidos Arizona isn’t hoping for any sort of war, but believes it may be unavoidable. “For generations, our people have prepared us to take back the lands of the Southwest that were stolen from our Mexican ancestors. Because of the bad economy and many racist laws, Latinos will be forced to fight sooner than later,” says Mrs. Maldonado.

Latino groups believe they have enough people in states such as California, Nevada, Arizona, New Mexico, and Texas to successfully wage a war on the United States.  Who’s side will you be on?

FOX Undercover: Secure Communities by year’s end?

BOSTON (FOX 25 / MyFoxBoston.com) – The federal Secure Communities program
could be running in at least some parts of Massachusetts by the end of the year
despite Gov. Patrick’s opposition to the program, one local sheriff says.

New attention is being focused on Secure Communities after the Aug. 20 death
of Matthew Denise, who was hit and killed while riding his motorcycle. Police
say Nicolas Guaman, an illegal immigrant from Ecuador, was drunk and behind the
wheel of a pick-up truck that hit him.

Gov. Patrick, who announced in June that the state would not sign onto Secure
Communities program, defended the stance, saying it was a drunk driver that
killed Denise, not “illegal immigration”.

That stance has been drawing criticism, including from FOX News channel’s
Bill O’Reilly, who took to the national airwaves last week to bash Patrick.

“Who has blood on their hands?” O’Reilly asked.

The US Bureau of Immigration and Customs Enforcement, or ICE, is moving ahead
in implementing Secure Communities in Massachusetts and around the country, and
plans to have the program nationwide by the end of 2013.

But some in Massachusetts don’t want to wait that long.

A handful of sheriffs, including Worcester County Sheriff Lewis Evangelidis,
have asked ICE to let them activate the program in their counties as soon as
possible.

Evangelidis told FOX 25 today he’s hopeful to have the program by the end of
the year.

“I had several conversations with immigration and ICE last week. They assured
me they have full capacity to implement this program, so I anticipate as we go
on and we have meetings with them over the next few weeks. We hope to get this
implemented within the year and well in advance of the state of Massachusetts or
what I expect will be the federal deadline of the end of 2013,” he
said.

“Then Vargas fired seven shots, awakening a neighborhood and triggering a rash of 911 calls, but missing his intended victim, who fled toward Elm Street.

When police arrested him minutes later, Vargas was illegally carrying two loaded handguns, .25-caliber and .45-caliber weapons, one of them stolen, accordingto police. ”

“The letter of support for Vargas now connects Lantigua to an individual who carried illegal and stolen firearms and wasn’t afraid to pull the trigger.”

This is the type of criminal that Secure Communities is trying to get off our streets. Both Mayor Lantigua and Governor Patrick have stated that they are oppsed to implementing this program that removes criminal illegal aliens.

 Lantiguas support of felons and and his open opposition to his police department is just another reason to recall the Mayor!

Massachusetts won’t sign onto immigration check program

BOSTON (FOX 25 / MyFoxBoston.com) – Gov. Deval Patrick made a major reversal today, saying he’s not signing up for a controversial program aimed at deporting illegal immigrants with serious criminal records.

Gov. Patrick’s public safety secretary made the announcement in a letter released today that was sent to the U.S. Department of Homeland Security on Friday.

 Secure Communities has been a political hot potato for Gov. Patrick since last fall, when FOX Undercover first revealed his administration had been dragging its feet for a year on the federal government’s request to bring it to Massachusetts. Patrick eventually decided to sign on, but reversed course yesterday.

“I think this is the right decision for the Commonwealth. From a public safety position we’ll continue to work with the FBI and (U.S. Immigration and Customs Enforcement) for convicted felons who are undocumented people. But the Secure Communities program is not for us,” Patrick told reporters today.

Secure Communities links state and local police with US immigration authorities by automatically sharing fingerprints of arrestees with US immigration authorities. It’s supposed to identify and help deport illegal immigrants who have committed serious crimes.

Patrick says he supports that goal, but says Secure Communities is leading to the deportation of immigrants who haven’t committed crimes, or who have committed minor offenses.

His refusing to sign is a reversal from his stance last December, when he promised to activate Secure Communities state-wide under pressure from U.S. Immigration and Customs Enforcement, better known as ICE.

“Governor, are you going easy on criminal aliens?” asked FOX Undercover reporter Mike Beaudet.

“No we’re not,” replied Patrick. “We have consistently sent all fingerprints to the FBI. That’s a program and a practice that has gone on for some while now. Long before Secure Communities. And we have referred convicted felons to ICE for deportation and we will continue to do that.”

“Why the change since December?” asked Beaudet.

“The change since December is that the program is not mandatory,” Patrick replied.

The prospect of joining Secure Communities drew protests from immigrant advocates.

But now Patrick’s reversal is drawing fire.

“This is much more about politics than public policy,” said state Rep. Brad Jones, R-North Reading, the House Minority Leader. “And to the extent there were concerns about how the program was structured on the federal level, it seems to me based on the governor’s own representations, there’s probably nobody better to advocate with the administration about possible positive changes that need to be made to that program given the strong relationship that the governor trumpets with the president.”

Gov. Patrick’s decision has drawn cheers from immigrant advocates and the ACLU of Massachusetts, but Secure Communities may not be gone for good.

One of the governor’s top public safety official says the federal government can activate the program all on its own, and will do so by 2013.

ICE released a statement saying in part, “ICE regularly analyzes the effectiveness of its enforcement programs, as it is currently doing with Secure Communities. ICE looks forward to sharing the results of its analysis with the State of Massachusetts and to continuing to work with Massachusetts to ensure that those who are illegally in this country and have also committed a crime under state law are removed in order to protect the citizens and communities it serves.”

Boston’s police have used Secure Communities since 2006, and Gov. Patrick cited a large number of deportations of non-criminals because of that program as a reason for not joining. But Boston Police Commissioner Ed Davis says the program is working and is not deporting non-criminals.

This is what is in store for MA police officers and residents, unless Governor Patrick implements Secure Communities as he has promised to do but is  now dragging his feet. Do we want to wait until a police officer or loved one is killed?

HOUSTON—Few things underscore the random nature of death like the orderly precision of a slain police officer’s funeral. Officer Kevin Will’s funeral was no exception.

“A fallen officer. It shouldn’t have happened. It’s a sad day for everybody,” said Roger Solazar, a Metro police officer attending the funeral.

A sad day for everybody — none more so than the officer’s pregnant widow, Alisha Will, and their two children. 

In March 2009, Will quit his job in banking and took a pay cut so he could pursue his calling to become a Houston police officer. His career was cut short early Sunday morning, as he worked the scene of a motorcycle accident on the North Loop. Police say a car driven by Johoan Rodriquez, an illegal immigrant from Mexico, sped through the barricade, striking Will and dragging his body along the freeway. Investigators say Rodriquez was intoxicated, his blood alcohol content nearly three times the legal limit.

But it’s what officer Will did in his last moments that made him a hero.

“For it was in his last moment that he decided to lay his life down for another, as he pushed the citizen he was talking to aside to safety, even though it meant he would lose his own life. Kevin is a hero by all standards,” said HPD Chaplin Monty Montgomery.

By all standards, a hero whose legacy will live on, despite his untimely death.

Rodriguez has since been charged with intoxication manslaughter.

Prosecutors claim that Rodriguez had been deported twice and was a member of the MS-13 gang.

Defense attorney Eric Clay admitted that his client had been living in the country illegally, but said he’d been here for most of his life and even attended – but did not graduate from – Sam Houston High School. Clay adamantly denied the prosecution’s allegations that Rodriguez was a gang member.

Rodriguez remained in the Harris County Jail without bond Thursday

As a disabled veteran from the United States Navy we support secure communities to be imposed in this state to ensure that we don't become a sanctuary state.
